We sell military surplus and related products to customers in Canada.
2. Eligibility

- Product descriptions and images are provided for reference only. We make every effort to ensure accuracy but can't guarantee that colors or details will match exactly what's delivered

3a. Product Restrictions
Military surplus products sold on this site are civilian items intended for collecting, outdoor, or recreational use. It's your responsibility to verify and comply with all applicable federal, provincial, and local laws and regulations regarding the purchase and use of such items in your province or territory. Some items may be restricted or prohibited in certain jurisdictions.
4. Pricing and Payment
All prices are shown in CAD ($) and include all charges from Surplus Tactical.
CUSTOMS DUTIES & BORDER FEES:
Most orders are NOT subject to customs duties or taxes when entering Canada because:
- Our fulfillment partners declare shipments with values typically under the $150 CAD duty-free threshold
- No duties apply under CUSMA/USMCA for qualifying goods
However, in rare cases where declared value exceeds thresholds or customs authorities apply different classifications, you may be responsible for any duties or taxes assessed by CBSA (Canada Border Services Agency). These charges are determined by Canadian customs and are beyond our control.

5. Shipping and Delivery
- We currently offer shipping across Canada
- Our products ship from fulfillment partners primarily located in Asia
Shipping costs:
- Orders under $69 CAD: Flat rate $5.99 CAD
- Orders $69 CAD and over: Free shipping
Estimated delivery times:
- Order processing: 3-5 business days
- International shipping: 7-15 business days
- TOTAL: 10-20 business days from order confirmation
Times may vary depending on location and customs procedures. We're upfront about this—our products ship from Asia, which means longer delivery times but better prices on authentic surplus gear.

6. Returns and Refunds
- We accept returns according to our Return and Refund Policy
- Returned items must be unused, in their original packaging, and sent within the specified return period
- Some items may not be eligible for return for hygiene or safety reasons
7. Intellectual Property
All content on https://surplus-tactical.com, including images, text, graphics, and logos, is owned by Surplus Tactical or its suppliers and is protected by intellectual property laws. You can't reproduce, distribute, or modify any content without prior written permission.
8. Limitation of Liability
Nothing in these terms limits or excludes your legal rights as a consumer under Canadian federal and provincial consumer protection laws, including rights related to:
- Defective or non-conforming products
- Misleading statements
- Death or personal injury caused by negligence
To the maximum extent permitted by applicable law, Surplus Tactical is not liable for:
- Indirect or consequential damages arising from product use
- Business losses or loss of profit
- Improper use of products contrary to provided instructions
This limitation doesn't apply to rights that by law cannot be excluded or limited.
9. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of the province or territory in Canada where you reside as the consumer.
However, for operational and administrative matters related to our company (FPFM SIA), Latvian law applies as FPFM SIA is a private limited company registered in Latvia (Komercreģistrs No. 40203710743).
Consumer Protection: Regardless of the governing law stated above, you retain all mandatory consumer rights under Canadian federal law and the consumer protection laws of your province or territory of residence. Nothing in these terms limits your legal rights as a Canadian consumer.
DISPUTE RESOLUTION:
If you have a complaint, contact us directly first at contact@surplus-tactical.com. We'll work with you to resolve any issues.
If we can't resolve your complaint directly, you may have recourse through:
- Your provincial consumer protection office
- Small claims court in your province
- Alternative dispute resolution services available in your province
Canadian consumers may bring proceedings before the courts, small claims courts or consumer tribunals of their province or territory of residence. Canadian consumers' substantive and procedural rights cannot be excluded, restricted or waived by contract — see in particular Ontario Consumer Protection Act, 2002 (SO 2002, c 30, Sch A) s 7; Quebec Consumer Protection Act (CQLR c P-40.1) art 19 and Civil Code of Québec art 3149; British Columbia Business Practices and Consumer Protection Act (SBC 2004 c 2); and the Supreme Court of Canada's decision in Douez v Facebook Inc, 2017 SCC 33. Nothing in these Terms operates to deprive Canadian consumers of their rights under federal law (including Canada's Anti-Spam Legislation, S.C. 2010 c 23, "CASL") or under any applicable provincial or territorial consumer protection legislation.
